1. STANDARD TERMS AND CONDITIONS

​

Jake Decorates will take reasonable commercial steps to protect the Customer’s privacy in accordance with the Australian Privacy Principles of the Privacy Act 1988 (Cth).

 

2. SUPPLY OR HIRE OF GOODS AND SERVICES

​

2.1. Jake Decorates will supply Goods and Services pursuant to this Service Agreement and these Terms.
2.2. Jake Decorates reserves the right to decline supply at its discretion.
2.3. No supply unless:

• The Quote and Terms are approved in writing; and

• The Secure Deposit and any Purchase or Hire Payment have been received.
  2.4. If unavailable, products or services may be substituted with alternatives of equal value.
  2.5. Additional work only proceeds with Customer approval.

 

3. CUSTOMER OBLIGATIONS

3.1. Provide all necessary instructions, documentation, and access.
3.2. Provide safe, clear, and reasonable access.
3.3. Use any hired Goods only for their intended purpose, safely and lawfully.
3.4. Prevent unauthorised persons from tampering with Goods.
3.5. Cover damage, loss, theft, or destruction of hired Goods.
3.6. Supervise children and pets during installation and pack-down.
3.7. Acknowledge risks with large trees, décor, or lighting once installed.

 

4. PURCHASE AND HIRE PAYMENT

4.1. Fees include GST and may change without notice.
4.2. Tax invoices issued; payment via direct deposit.
4.3. Quotes valid for 30 days.
4.4. Secure Deposit required to confirm booking (non-refundable unless specified).
4.5. Remaining balance due 7 days prior to supply.
4.6. Extensions invoiced weekly or monthly.
4.7. Payment covers consultation, design, delivery, installation, and pack-down.
4.8. Exclusions in the Quote are not included.
4.9. Outstanding payments may result in service suspension or Bond retention.
4.10. Ownership of purchased Products passes only after full payment. Hired Products remain the property of Jake Decorates.

 

5. BOND (IF APPLICABLE)

5.1. Bond payable if stated in the Quote.
5.2. Refund within 5 business days post-collection, less deductions.
5.3. Deductions apply for damage, loss, or repair.

 

6. CONCEPT ART AND DESIGN

​

6.1. Concept visuals are design intent only.
6.2. Natural materials may vary.
6.3. Designs remain Jake Decorates' intellectual property.
6.4. Colour variations may occur between digital and real-life finishes.
6.5. Customer changes without consultation void outcome guarantee.

 

7. VARIATIONS

​

7.1. Written requests are required for changes and may incur fees.
7.2. Reasonable time extensions apply if the Customer causes delays.
7.3. Product substitutions may be made if necessary.

 

8. DELIVERY, INSTALLATION, HANDOVER AND PACKDOWN

​

8.1. Delivery times are estimates only.
8.2. Full payment is required prior to delivery/installation.
8.3. Reasonable access must be ensured; redelivery fees apply.
8.4. Customer must confirm Goods fit in the intended space.
8.5. Floor and surface protection is the Customer’s responsibility.

8.6. The Customer is responsible for ensuring adequate electrical supply for decorations and lighting.
8.7. Customer is responsible for disposal of packaging.
8.8. Stairs or difficult access may attract extra charges.
8.9. Minimum 14 working days’ notice unless otherwise agreed.
8.10. Risk in the Products (hired or purchased) passes to the Customer upon delivery.

8.11. Packdown dates will be scheduled by Jake Decorates and may vary depending on operational schedules.

 

9. CANCELLATION POLICY

​

9.1. Cancellations within 15 days of scheduled service are non-refundable.
9.2. If Jake Decorates cancels, a full refund is provided.
9.3. Change-of-mind returns not accepted.
9.4. Refunds only per Australian Consumer Law.

 

10. REFUND POLICY – SPECIFIC SERVICES

10.1. No refunds/exchanges for change of mind on purchased trees or decorations.
10.2. No refunds/exchanges for change of mind on Christmas Styling Services.
Exchanges apply only for faulty or damaged items.

 

11. PHOTOGRAPHY & PROMOTION

​

Jake Decorates may photograph or film completed work for promotional use unless the Customer declines in writing.

 

12. LIABILITY

​

12.1. Liability is limited to total fees paid.
12.2. Customer indemnifies Jake Decorates for injury, loss, or damage caused by the Customer or the Products.
12.3. Further indemnity for loss/damage caused by Customer breach or negligence.
12.4. No liability for incidental, special, or consequential losses unless required by law.
12.5. Nothing excludes liability for death or personal injury caused by Jake Decorates’ negligence.

12.6. Jake Decorates is not responsible for damage to fragile or sentimental items supplied by the Customer.

13. PROPERTY ACCESS & SAFETY

​

13.1. Customer ensures safe, clear access for staff and contractors.
13.2. Jake Decorates is not liable for delays or inability to perform due to unsafe conditions.

 

14. FORCE MAJEURE

​

No liability for failure or delay caused by circumstances beyond Jake Decorates' control, including weather, natural disasters, pandemics, or government restrictions.

 

15. GOVERNING LAW

​

This Agreement is governed by the laws of New South Wales, Australia. Disputes will be resolved in NSW courts.

 

16. ELECTRONIC AGREEMENT

​

This Agreement may be signed electronically and is legally binding under the Electronic Transactions Act 1999 (Cth).

 

17. BOOKING AND SERVICE AGREEMENT PROCESS

​

17.1. A Quote will be emailed.
17.2. A Service Agreement must be signed before work begins.
17.3. Customer completes a Booking Form to select service dates.
17.4. No work commences until the signed Service Agreement and Secure Deposit are received.

 

18. CHANGES TO TERMS AND CONDITIONS

​

Jake Decorates reserves the right to update these Terms and Conditions at any time without notice. The latest version is available at www.jakedecorates.com.au

 

By agreeing to our Service Agreement, the Customer agrees to be bound by the latest Terms.

 

19. CONDITION OF HIRED PRODUCTS

​

Hired Products may be pre-loved or vintage. Minor wear is expected and is not grounds for refund or replacement.

​

20. THIRD-PARTY VENUE RESPONSIBILITY

​

The Customer is responsible for obtaining any venue permissions, permits, or approvals. Jake Decorates is not liable for venue-related fines or refusals.

21. ELECTRICAL USAGE AND SAFETY

​

Jake Decorates ensures the safe installation of supplied lighting or electrical décor. Ongoing operations or faults post-installation are the Customer’s responsibility. The Customer is responsible for ensuring adequate electrical supply for decorations and lighting.

22. STORAGE, COLLECTION, AND FAILURE TO RETURN HIRED GOODS

​

The Customer must make Hired Products available for collection as agreed. Late returns or non-returns may incur extra charges or replacement costs.

23. INSURANCE RESPONSIBILITY

​

Jake Decorates is not responsible for loss, theft, or damage once items are delivered. Customers should arrange their own insurance.

 

24. DESIGN SCOPE CHANGES & ADDITIONAL CHARGES

​

Post-approval design changes or additions may incur extra charges. Jake Decorates will confirm costs prior to changes.

 

25. AESTHETIC OUTCOME DISCLAIMER

​

Aesthetic outcomes are subjective. No guarantee is made regarding personal taste once the agreed design is completed.

 

26. SUBCONTRACTING AND THIRD-PARTY ENGAGEMENTS

​

Jake Decorates may be subcontracted by other businesses. When subcontracted:

• Jake Decorates acts under the primary contractor’s direction.

• The primary contractor is responsible for project management and client communication.

• Jake Decorates accepts no liability for loss or disputes from decisions by the primary contractor.

• Any issues regarding scope, design, or budget are the responsibility of the primary contractor.

• The Customer acknowledges that subcontracted projects may reflect the primary business's style, not Jake Decorates.

 

27. REPAIR OR REPLACEMENT OF HIRED PRODUCTS

If a Hired Product fails or requires repair, the Customer must notify Jake Decorates immediately.

 

Jake Decorates will make reasonable efforts to repair or replace the item. Due to stock or seasonal limits, the replacement may differ in value or appearance.

28. ONLINE CONSULTATIONS AND VIRTUAL DESIGN SESSIONS

 

• Online Platform Online consultations are conducted via the platform specified in your booking confirmation.

• Clients are responsible for ensuring they have a stable internet connection, suitable device, camera, and microphone prior to the session.

• Clients are responsible for joining the session at the scheduled time. If you are more than 15 minutes late without prior notice, the session may be considered forfeited and may not be rescheduled.

• If technical issues arise on our end, we will make reasonable efforts to reconnect or reschedule the remaining session time. If technical issues occur on the client's end, the session will continue where possible, however additional time cannot be guaranteed.

• To make the most of your consultation, clients are encouraged to have photographs, room measurements, inspiration images, and any relevant information available before the session begins.

• Recommendations provided during online consultations are based on the information, photographs, videos, and measurements supplied by the client. Jake Decorates is not responsible for recommendations affected by inaccurate or incomplete information.

• Sessions are not recorded by Jake Decorates unless agreed in writing beforehand. Clients may not record, reproduce, distribute, or share any consultation without prior written consent.

• Any concepts, colour palettes, styling ideas, mood boards, or recommendations shared during the consultation remain the intellectual property of Jake Decorates until payment has been received in full. They are provided solely for the client's personal use and may not be reproduced, distributed, or used for commercial purposes without written permission.

• While every effort is made to provide expert advice and practical recommendations, Jake Decorates cannot guarantee a particular aesthetic outcome, product availability, or installation result following an online consultation.

28. ACCEPTANCE OF TERMS

 

By paying the Secure Deposit and/or confirming your booking, you agree to these Terms and Conditions.
